Completing your Bankruptcy Form online

This page has information about how to apply for bankruptcy once you’ve created your Insolvency Services account.

To apply for bankruptcy, you’ll need to complete and submit a Bankruptcy Form online.

If you’ve been made bankrupt by a creditor, you will also be able to submit your Bankruptcy Form online.

If you are applying for bankruptcy jointly with someone else, or you're applying with a partner of a business, you can use the online service to submit your bankruptcy application. In your form, state that you are jointly applying with someone else or as part of a partnership and provide their name. You will each need to complete separate applications and submit them within the same day.

Your personal details, employment and income, debts, money and bank accounts and general personal assets.

Your real estate, financial assets, money owed to you, assets owned by others that you may have contributed to, asset transfers, any other secured creditors, business, companies and trusts, any legal action and any proceeds of crime.

Application to suppress certain information from the NPII

If you believe your safety is at risk by publishing your address or other information on the National Personal Insolvency Index (NPII), you may apply to have your address hidden. To do this, you must submit your request at the same time as your Bankruptcy Form.

Getting help to complete the Bankruptcy Form

If you need help with your bankruptcy application, you can talk to a financial counsellor, registered trustee or other service provider. You must disclose the name of the person/organisation that helped you and any fees you paid for that assistance at question 17 of the Bankruptcy Form.

Using a registered trustee

Registered trustees won’t be able to lodge a Bankruptcy application online on behalf of their client, however a registered trustee can continue sending us their client’s completed application form to registry [at] afsa.gov.au.

Future enhancements to AFSA’s online services may include provision for registered trustees to lodge a bankruptcy application online on behalf of their clients. AFSA will consult with registered trustees and professional bodies about this provision.

Uploading supporting documents

In some circumstances, you may need to attach a file to support your bankruptcy application. When attaching supporting documents, make sure your attachment is less than 10MB.

There are only certain reasons you will need to upload a file. These are when:

There are a number of places where we will ask you to attach a file to support you application. These are when:

  • You have consent from a specific registered trustee to manage your bankruptcy. We will expect a signed copy of the Trustee Consent to Act Declaration to be uploaded here.
     
  • You wish to suppress your address from the National Personal Insolvency Index. You must complete a Request for information to not be on the NPII form and also upload documentation to support your situation.
     
  • You need to provide evidence of your connection to Australia. If you need to provide evidence you will need to provide documentary evidence that supports your Australian connection, which may include:
    • travel itinerary showing travels to and from Australia
    • evidence of overseas employment
    • most recent Australian tax return.
       
  • Applying for bankruptcy as part of business partnership. You must provide documentary evidence relating to the financial affairs of the partnership such as:
    • profit and loss statements
    • balance sheet
    • taxation documents.

Only in the circumstances mentioned above will we expect a file to be uploaded to support your application. Do not try to upload any other documents that aren’t related to the circumstances mentioned above.

Check the status of your bankruptcy application if submitted online

You can log in to your Insolvency Services account to check the status of your bankruptcy application at any time.

Status options that you may see include:

Draft

Bankruptcy Form has been commenced online but not yet submitted.

Submitted

You have submitted your application and we are currently reviewing it.

Accepted

We have accepted your application for bankruptcy and a bankruptcy number will be provided as your new reference number. You will receive a letter from AFSA advising you of next steps and your obligations while bankrupt. The bankruptcy number will also be available to you when you login to your Insolvency Services account.

Returned

We require more information from you to accept your form. The additional information you need to provide will be sent to your email address. You can log back into your online account to access your returned application and provide the information requested and re-submit your application.

Rejected

We have rejected your application. The reasons we have rejected your form will be sent to your email address.

Withdrawn

You have chosen to withdraw your application before AFSA has been able to process it.
