Understanding when you can complete an application on someone's behalf

In some situations, it may be possible to complete a bankruptcy application on behalf of someone else, by signing the debtor's petition on their behalf.

This can only be done where the applicant is:

  • blind, partially sighted, illiterate or partially literate
  • non-English speaking
  • unable to complete the form due to physical incapacity.

Note: 'Physical incapacity' means an inability to act due to illness, injury or a physical condition. It does not include where an individual is unable to sign due to absence (for example, living remotely, being overseas or in prison).

If one of the above situations apply, the person assisting the applicant cannot use AFSA's Online Services to complete the application on the applicant's behalf. A paper-based submission will be required. To download the required forms, see Forms for bankruptcy application.

For any other situation, including applications by mentally incapacitated persons (where the applicant is unable to complete the form themselves), please contact us.

This process doesn't apply to registered insolvency practitioners or financial counsellors who are simply assisting someone with the bankruptcy process.

Steps to complete a bankruptcy application on behalf of someone else

When completing the forms on behalf of the applicant, you can only submit a non-online lodgement.

Step 1: Download a paper copy of the Debtor's Petition and Statement of Affairs forms. You will also need to complete a 'Statement by person signing on behalf of the debtor' form.

Step 2: Make sure all sections of the Debtor's Petition and Statement of Affairs have been completed.

Step 3: Complete and sign the 'Statement by person signing on behalf of the debtor' form.

Step 4: Submit the completed Debtor's Petition, Statement of Affairs forms and the required statement, along with any other attachments via:
