On 28 June 2018, Ms Thi Sot Bui pleaded guilty in the Sunshine Magistrates’ Court of one count of preparing to leave Australia on 28 September 2016 without the Trustee’s consent, contrary to Section 272(1)(c) of the Bankruptcy Act 1966 (Cth).
On 27 September 2016, Ms Bui made an attempt to leave Australia from Tullamarine Airport, but was prevented from doing so by Australian Federal Police, due to the fact that she was an undischarged bankrupt.
Subsequent to being stopped, Ms Bui had a telephone discussion with her Trustee’s office, and agreed to attend a meeting at the Trustee’s office the following week.
The Trustee’s office advised her that she did not have permission to leave Australia.
The following day, on 28 September 2016, Ms Bui attempted to leave Australia from Brisbane Airport, and was again prevented from leaving Australia by the Australian Federal Police.
At the time Ms Bui attempted to leave Australia, she had not yet made arrangements with her Trustee to begin repaying the money owed through regular income contributions.
Ms Bui was convicted and released upon entering into a recognisance release order with a security of $500 and a condition that she be of good behaviour for 12 months.
The matter was prosecuted by the Office of the Commonwealth Director of Public Prosecutions on behalf of the Australian Financial Security Authority.
