Media release: WA (Culleton) – Bankrupt convicted for refusing to file a Statement of Affairs

On April 3 2019, Mr Rodney Culleton of Maylands, WA, was convicted, fined $2,000 and ordered to pay costs for failing to file a Statement of Affairs.

Mr Culleton became bankrupt by order of the court on 23 December 2016, but has publicly refused to accept the ruling, or to cooperate with the administrative process for managing a bankruptcy and repayment of debts.

The matter was prosecuted by the Commonwealth Director of Public Prosecutions on behalf of the Australian Financial Security Authority.Key facts:

  • Mr Culleton became bankrupt under a sequestration order made on 23 December 2016.
  • On 14 September 2018, Mr Culleton entered a plea of not guilty to a charge of contravening section 54(1) of the Bankruptcy 1966.
  • On 27 and 28 February 2019, a summary trial was held before Magistrate De Vries in the Perth Magistrates Court.
  • On 3 April 2019, Magistrate De Vries found Mr Culleton guilty and imposed a fine of $2,000 plus costs.
